Residential Limited 13 (RL-13) zones require a 15 foot side yard setback from the property line. The request is for a 1.6 foot setback modification to allow for a 13.4 foot setback for a 24 x 37 addition on the west side of the structure.
Section 806 Administrative Modification of the Zoning Ordinance permits a maxi- mum of 15% or 1.6 feet of administrative modification. Subsection 3 of section 806 states:
If written objection is received within 14 days, the request for a modification shall be scheduled for the next available hearing before the Zoning Board of Review for an application for a dimensional variance following the standard procedures for such variances. If no written objections are received within 14 days, the Zoning enforce- ment officer shall grant the modification.
